General Terms and Conditions

1. Area of General Terms and Conditions

The following terms and conditions are valid for all courses, lessons, workshops and events (following named as courses or services) offered by GermanWithoutBorders in Austria (following named as GWB) and GWB-Jähnigen in Liechtenstein (following named as GWB). It shall be pointed out that certain services refer to special conditions of registration.

2. Registration

Before any registration we recommend arranging a free trial lesson with GWB. Within the trial lesson all administrative and organizational aspects can be explained.

Registration is possible in person, by phone (0049-172-6368573), by Email (office@germanwithoutborders.com) or online by using the corresponding form.
In order to handle the registration GWB will need all relevant personal data.

If the client has not reached the age of 18 years a legal guardian or parent is pleased to do the registration.

Since the capacity of participation is limited registrations will be considered in their chronological order.

3. Conclusion of a Contract

A registration with GWB is not a fixed booking. With the registration the general terms and conditions are accepted by the client.

The client will be registered only if all payments have been made and the registration is confirmed by GWB.

A contract results when the full payment of the course or service fee has been made.

4. Prices

Prices for private persons are calculated for each lesson whereas a lesson takes 45 minutes.

Prices depend on the number of participants for a course. Beginning with the fourth participant the course price is the same for every further participant.

Prices for private persons will be announced personally (i.e. with a trial lesson) before registration.

Prices for companies will be announced in a separate written offer as well as specific related conditions.

Prices do not include value-added tax.
For courses or services outside the head office of GWB in Feldkirch the teachers travel expenses can be added.

5. Conditions of Payment

A fixed booking results when the payment of the course or service fee has been made in time.

The payment has to be made at the latest five days before the course or service starts. It has to be paid in cash, via bank transfer or via the service provided by GWB. Hereby the client acknowledges the fact that GWB uses third-party payment services. Terms and conditions of these third-party payment services are valid additionally to those of GWB.

Using bank transfer for paying the course or service fee the client has to take into account the duration of a bank transfer. It is in the clients responsibility that all payments are made completely and in time.

5.1. Textbooks and Material

Textbooks, materials and certificates of attendance are not included in the course or service fee. Material supplied by GWB must not be copied.

6. General Conditions of the Courses

6.1. Teaching Time and Courses

A Teaching Unit (TU) takes 45 minutes. If the teacher and the client agree there will be an optional break of 5 minutes after every TU.
After three connected TUs (135 minutes) a break of minimum 10 minutes will be compulsory.

Private Persons are allowed to book One-to-One- or group course lessons. Lessons in a group course start with two people.

Lessons can be booked as single lessons (1 TU = 45 minutes) or as a bloc consisting of 10 lessons (5×2 TUs).

For companies GWB we will provide an individual offer.

6.2. Public Holidays

GWB is closed on public holidays in Austria, Switzerland and Liechtenstein and no classes or services can be offered or guaranteed in these countries.

If more than one public holiday is affecting the course or service period TUs can be made up for with the agreement among the client and GWB. This fact is not mandatory.

The majority of the course participants decides and agrees on a new date for repeating any course or service. Repeating a course has to be finally approved by GWB corresponding to its availability and capacity.

For participants who cannot take place in a course repetition, a refund of these TUs cannot be made.

6.3. Minimum Age

GWB offers courses and services for young adults in the age of 16 years and adults in the age of 18 years. For participants in the age of under 18 years a registration for courses or services is possible only with a written confirmation by a legal guardian.

6.4. Teaching Staff

Booked and confirmed courses or services can be held only if teachers are available.

There is no claim to be taught by a certain teacher.

A teacher can be changed or switched among the courses or services. This does not verify a cancellation of the course or service.

6.5. General Course Cancellation – Postponement

If the minimum number of participants can not be reached or if certain teachers are not available, GWB has got the right to cancel, shift or postpone the whole course or service.

6.6. Incapacity of Teaching Staff

In the case of incapacity of a teacher, GWB will organize a replacement or offer another date for the course or service.

If replacement or shifting of the course or service is not possible, GWB will refund the relevant payment.

6.7. Cancellation – Single Lesson (Private Person)

Shifting or cancellation of a single TU is flexible and out of charge, if it is announced 24 hours (one working day) before the start of the TU (i.e. a course on Monday has to be canceled the Friday before). The cancellation has to be made personally or by phone.

If the deadline of cancellation can not be kept, the full course or service fee has to be paid.

If the deadline of cancellation has been kept, the teacher and the client can agree on another date for the relevant course or service.

If the client is too late (more than 20 minutes after the start of the course or service) or is not appearing at all, the course or service has to be paid completely. In this case, there is no right for repeating the course or service, and no right for the refund of the course or service fee.

If the TU is part of a group course, the client has no right for repeating the course or service. In this case, the reasons for cancellation or not appearing are not relevant and it is GWB´s decision to offer another date for the course or service.

6.8. Cancellation – Bloc Courses (consisting of ten Teaching Units) – (Private Person)

TUs within bloc courses or within special agreements/packages have to be canceled by phone or personally 24 hours (one working day) in advance.

If the client is too late or not appearing at all, the course or service has to be paid completely. In this case, there is no right for repeating the course or service, and no right for the refund of the course or service fee.

6.9. Cancellation – Companies

Cancellation of company courses can be done only in written form (either via post or Email). If the cancellation is made within 10 working days before the start of the course or service, the client has to pay 50% of the course or service fee. If the cancellation is made within 5 working days before the start of the course or service, the client has to pay the full amount of the course or service fee.

6.10. Exclusion by GermanWithoutBorders

If a client is disturbing any course or service or is ignoring or disregarding the rules or the general terms and conditions of GWB, he/she can be excluded from the course or service without any claim for refund or replacement.

7. Course Success

GWB cannot guarantee any specific course goal or success.

It is in the client´s responsibility to cooperate and work intensively to reach the course goal or success.

8. Right of Withdrawal

With a booking or reservation for any course or service of GWB (via Post, Fax, Email, Homepage or in person) the client has got the legal right to resign from the contract within 14 days. The written resignation has to be sent at:

GWB will refund all payments made by the client.

If the start of the course or service is within this 14 days period of the resignation period, the client has to pay 10% of the course or service fee.

9. Liabilities, Compensation and Warranty

The client is liable for any damages at the place of the course or service and he/she is responsible for the compensation of any damage.

GWB does not take any liability for any damages, injuries or loss of personal goods.
For clients under the age of 18 the legal guardian(s) are responsible and have got the liability.

Activities, trips, journeys and other services are at one´s own risk.

GWB does not provide any health or accident insurance.

GWB is not liable for the availability or reachability of the web page “www.germanwithoutborders.com”.

GWB is not liable for damage due to a force majeure.

10. Privacy Protection

All personal details of the client will be treated confidentially.

Personal data will not be given to any third-party. Personal data are kept for internal use only.

11. Integrated Third-Party Web Pages

Third-party web pages or links can be integrated on the GWB´s web page. GWB is not responsible and does not have any influence on any content. GWB distances oneself from any offensive, non-legal or pornographic content.

The general terms and conditions of the third-party web pages apply additionally to those of GWB.

12. Usage of Images

With conclusion of a contract the client or the clients legal guardian(s) agree with the usage and storage of personal images of the client.

The clients dignity must be guaranteed all time. The client or the clients legal guardian(s) also agree with the usage of personal images on the GWB´s web page – including social platforms, prospects, brochures, marketing material and so on.

If the client or the clients legal guardian(s) do not agree, they have to announce it in written form at:

13. Place of Jurisdiction

In case of lawsuit concerning the execution, interpretation or application of the presented general terms and conditions, the regional court in Feldkirch, Austria will be in charge.

14. Final Clause

Only the legal right of the Federal Republic of Austria can be applied. Changes or amendments of the general terms and conditions can be made only in written form.

If one of the above mentioned regulations is legally void, GWB is authorized to replace it in an effective manner. If that is not possible, legal regulation will be applied.
